NATHANIEL R. JONES, Circuit Judge. Plaintiffs-Appellants, commercial fishermen in northeastern Ohio, appeal the district court's grant of summary judgment to the defendants Frances Buchholzer, Director, and Richard Pierce, Chief of the Wildlife Division of the Ohio Department of Natural Resources. Although there may be doubt as to the plaintiffs' chances of ultimate success, we nevertheless find that the district court abused its discretion by dismissing the plaintiffs' action without allowing for adequate discovery. Accordingly, we REVERSE the district court's grant of summary judgment to the defendants and remand this case for further proceedings.
